This electronic record requires neither physical nor digital signatures.

The website www.cuddloop.com (hereinafter referred to as “Cuddloop”, “Site”, “we”, “us”, or “our”) is owned and operated by Cuddloop. By accessing, browsing, or transacting on this Site, you contractually agree to be bound by these Terms of Use. Our Privacy Policy, Return & Refund Policy, and Shipping & Delivery Policy form an integral part of these Terms and are incorporated herein by reference. If you do not agree to these terms, please discontinue using the Site immediately.

2. User Eligibility & Account Registration

  • Eligibility: By using this Site, you represent that you are at least 18 years of age and fully capable of entering into a legally binding contract under Indian law. Minors may only browse or transact under the active supervision of a parent or legal guardian.
  • Account Security: To purchase products, you may register an account. You are solely responsible for maintaining the strict confidentiality of your username, password, and restricted access to your account. You agree to accept liability for all activities occurring under your credentials.
  • Account Termination: Cuddloop reserves the right, at its discretion and without prior notice, to suspend or terminate accounts, refuse service, or cancel orders if a user provides fraudulent data, maintains malicious duplicate accounts, or abuses our returns policy.

3. Products, Pricing, and GST Invoices

  • Accuracy: We strive to present our apparel, accessories, and product details as accurately as possible. However, actual colors and textures may vary slightly depending on your electronic display settings.
  • Pricing & Invoicing: All items are displayed in Indian Rupees (INR) and are inclusive of GST unless stated otherwise. Tax invoices will be issued electronically where applicable and sent to your registered email address.
  • Pricing Errors: If a product is accidentally listed with an incorrect price or erroneous description, Cuddloop reserves the right to cancel or refuse any orders placed for that item. If payment has already been collected, a full refund will be processed back to your original payment method via our payment gateway.
  • Inventory Availability: Stock levels change rapidly. If an item becomes unavailable after an order configuration is complete, our team will reach out to offer a replacement or issue an immediate, full refund.

4. Order Cancellation Policy

  • Cancellation Before Dispatch: Customers can request to cancel their order at any time before the product has been handed over to our courier partner (dispatched).
  • Prepaid Orders: If a prepaid order is successfully canceled before dispatch, a full refund will be processed back to the original payment source via Razorpay within the standard processing window.
  • Cancellation Denial: Once an order has been dispatched from our facility and a tracking ID has been generated, the order cannot be canceled. In such cases, the user must follow our standard Return & Refund Policy upon delivery.

5. Shipping & Delivery Disclaimer

  • Timeline Estimates: Delivery timelines displayed on the Site are estimates only and may vary due to logistics partner operations, weather conditions, public holidays, regional disturbances, or other unforeseen circumstances. Cuddloop cannot guarantee exact delivery dates.
  • Third-Party Logistics: Delivery is handled by independent courier partners. Cuddloop is not liable for delayed delivery caused solely by courier operations.
  • Incorrect Address Responsibility: It is the user’s responsibility to provide an accurate, complete delivery address and contact number. Cuddloop will not be held responsible for non-delivery or shipping delays caused by incorrect or incomplete address inputs provided by the customer. Any re-shipping charges incurred due to incorrect details will be borne by the customer.

6. Electronic Communications

By providing your contact details and accepting these Terms, you consent to receive transactional notifications (such as order confirmations and shipping updates) and promotional communications from Cuddloop via email, SMS, WhatsApp, or other electronic means, in accordance with applicable Indian laws and telecom regulations. You may opt out of promotional communications at any time by utilizing the unsubscribe or opt-out links provided within the messages.

7. Secure Payments via Razorpay

All digital financial transactions on Cuddloop are securely handled via Razorpay, an RBI-authorized payment aggregator.

  • We accept Credit Cards, Debit Cards, Net Banking, UPI, and authorized Wallets.
  • Cuddloop acts as an intermediary website and does not collect or store your raw, sensitive credit card information or banking passwords.

8. Acceptable Use & Content Submissions

You are strictly prohibited from utilizing the Site or uploading any content (such as customer reviews, images, or feedback) that:

  • Belongs to another person without explicit legal authorization.
  • Is defamatory, obscene, pornographic, pedophilic, invasive of privacy, or racially or ethnically objectionable.
  • Infringes upon any patent, trademark, copyright, or other proprietary rights.
  • Contains software viruses, malware, or any code designed to interrupt or limit the functionality of computer systems.
  • Uses any data extraction tools, scrapers, bots, or automated mining software to copy material for commercial or competitive use against Cuddloop.

9. Intellectual Property Rights

All content visible on this Site—including but not limited to imagery, text layouts, brand logos, graphics, icons, digital downloads, interface styles, and backend software—is the exclusive intellectual property of Cuddloop or its content suppliers, protected by national and international copyright laws. A limited, revocable license is granted to users solely for personal, non-commercial shopping purposes.

10. Force Majeure

Cuddloop shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by a Force Majeure Event—meaning acts or events beyond our reasonable control. This includes, without limitation: strikes, lockouts, industrial disputes, civil commotion, riots, invasions, terrorist attacks, wars, fires, explosions, storms, floods, earthquakes, epidemics, pandemics, natural disasters, internet service outages, telecommunication breakdowns, courier/logistics infrastructure failures, or restrictive government regulations and lockdowns. Our performance will be deemed suspended for the duration of the Force Majeure Event.

11. Liability, Consumer Rights & Indemnification

  • Consumer Rights Clarification: Nothing in these Terms limits, excludes, or modifies any mandatory consumer rights available to you under applicable Indian consumer protection laws.

13. Effect of Termination & Survival of Provisions

Notwithstanding the expiration, cancellation, or earlier termination of your account or user access, any provision of these Terms of Use that imposes or contemplates continuing obligations or legal rights of a party (including but not limited to Intellectual Property, Indemnities, Limitations of Liability, and Governing Law) will fully survive the expiration or termination of these Terms of Use.

Any legal proceedings, disputes, or claims arising directly or indirectly from the use of this website shall fall under the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
